What are the legalities of editing a deposition video?

While the rules regarding the editing of video depositions vary from state to state, they are substantially similar. An Accurate Vision Account Executive can assist you with information about applicable federal, state and local rules for your region.

Generally speaking, the procedure is as follows:

  • The entire video deposition is submitted to the judge, who reviews the transcript and rules on the objections. Where an objection is sustained, the judge may then allow the related question and answer to be removed from the video deposition.
  • A copy of the full deposition is then edited, so as to remove the objections, questions and answers that were approved for deletion by the judge. This is done using a copy of the video master, so that the original video of the full deposition is never altered.
  • The original and the edited versions of the video deposition are labeled, and the edited version is shown to the jury.
  • In some instances the court issues an order whereby video depositions may not be edited.

(See the Federal Rules of Civil Procedure for more information.)
